1. Agreement to These Terms

These Terms of Service ("Terms") form a binding agreement between you and Unheard Child Organization, a Colorado 501(c)(3) nonprofit corporation (EIN 41-4621534), ("Unheard Child Organization," "Organization," "we," "us," or "our") and govern your use of the website at unheardchild.org (the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms apply solely to the public-facing informational and marketing website currently operated at unheardchild.org and does not apply to any future online community platform, consent forms, member portal, counseling services, support forums, or other interactive services that may later be offered by the Organization. By using this Site, you agree to the practices described here.

2. About Unheard Child Organization

Unheard Child Organization is a mission-driven organization dedicated to advocacy, education, and support related to children whose experiences have gone unheard. The Site provides information about our mission, programs, resources, and ways to support our work.

3. Eligibility

The Site is intended for adults aged 18 and older. If you are between the ages of 13 and 17, you may use the Site only with the involvement and consent of a parent or legal guardian. The Site is not intended for, and we do not knowingly direct content to, children under the age of 13.

4. Important Notice — Not a Crisis Service or Professional Advice

The Site is not a crisis service. If you or someone you know is in immediate danger or experiencing a crisis, please contact emergency services (call 911 in the United States) or one of the resources below:

The information on the Site is provided for general educational and informational purposes only. No information provided through the Site should be relied upon as a substitute for individualized professional advice.

5. Acceptable Use

When you use the Site, you agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable law or regulation
  • Harass, threaten, or harm any person, or post content that does so
  • Identify, expose, or target any individual — including alleged offenders, victims, or other third parties — in a manner that could constitute harassment, defamation, or invasion of privacy
  • Submit false, misleading, or deceptive information
  • Attempt to access areas of the Site you are not authorized to access, or interfere with the Site's security, performance, or availability
  • Use automated systems (bots, scrapers, crawlers) to access the Site except for well-behaved search engine indexing
  • Reproduce, distribute, or create derivative works of Site content except as permitted under Section 6 or applicable law
  • Use the Site or any Site content, including stories, materials, data, text, images, or other content, for the purpose of training, developing, testing, or improving any artificial intelligence or machine learning system without our prior written consent

6. Right to Suspend or Terminate Access

We reserve the right, in our sole discretion, to suspend, restrict, or terminate access to the Site at any time and without notice if we believe a user has violated these Terms, applicable law, or engaged in conduct that could harm the Organization, the Site, or others.

7. Intellectual Property

All content on the Site — including text, graphics, logos, images, audio, video, and design — is owned by Unheard Child Organization or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to access and view Site content for your personal, non-commercial use.

You may share links to Site pages and quote brief excerpts for educational, journalistic, or commentary purposes with appropriate attribution. Any other use — including reproduction, republication, or commercial use — requires our prior written permission.

The "Unheard Child Organization" name and any associated logos and marks are our trademarks and may not be used without our permission.

8. Submissions and Communications

If you contact us through the Site, send us a message, share a story, or submit any other content or information ("Submissions"), you represent that:

  • You have the right to share the Submission
  • The Submission does not violate the rights of any third party
  • The Submission is truthful to the best of your knowledge

By making a Submission, you grant us a limited, non-exclusive, royalty-free, license to use, store, and internally review the Submission solely as reasonably necessary to respond to you, operate the Site, comply with legal obligations, and carry out our mission. We will not publish, share, or quote your personal story or identifying information publicly without your explicit, separate permission.

Please do not share confidential information, information about ongoing legal matters, or sensitive details about third parties (including alleged offenders, minors, or other survivors) through unsecured channels such as our contact form or email. Reach out by phone or in person if confidentiality matters to the conversation.

Submitting information through the Site, contact forms, or email does not create any counselor-client, therapist-patient, attorney-client, fiduciary, or other confidential or professional relationship between you and the Organization. Electronic communications may not be secure, and you should avoid transmitting highly sensitive or confidential information through the Site.

By contacting us or providing your email address through the Site, you consent to receive electronic communications from us, including responses to inquiries, newsletters, updates, and mission-related communications.

9. Mandated Reporting

Certain staff and volunteers may be mandated reporters under applicable law. If, in the course of communicating with us, you disclose information indicating that a child is currently being harmed or is at risk of harm, we may be legally required to report that information to appropriate authorities. We share this so you can make informed choices about what to disclose through the Site.

10. Donations

Donations made through the Site are processed by third-party payment processors and are subject to their terms. Donations are voluntary contributions to support our mission. To the extent permitted by law, donations are generally non-refundable; however, we will consider good-faith refund requests for processing errors or duplicate charges. Unheard Child Organization is a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code, and donations are tax-deductible to the extent permitted by law. Please consult your tax advisor for guidance specific to your situation.

11. Third-Party Links and Services

The Site may link to or integrate with third-party websites, services, and resources. We provide these links for convenience and do not endorse or assume responsibility for their content, policies, or practices. Your use of any third-party service is at your own risk and is governed by that service’s terms. We are not responsible for the availability, security, accuracy, or practices of third-party services.

12. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ITS CONTENT IS ACCURATE, COMPLETE, OR CURRENT.

NOTHING ON THE SITE CONSTITUTES MEDICAL, PSYCHOLOGICAL, LEGAL, OR OTHER PROFESSIONAL ADVICE, AND NO PROFESSIONAL RELATIONSHIP IS CREATED BY YOUR USE OF THE SITE. YOUR USE OF THE SITE AND RELIANCE ON ANY CONTENT IS SOLELY AT YOUR OWN RISK.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, UNHEARD CHILD ORGANIZATION AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

14. Force Majeure

We shall not be liable for any delay, interruption, or failure in performance resulting from causes beyond our reasonable control, including acts of God, internet outages, cyberattacks, labor disputes, governmental actions, or failures of third-party providers.

15. Indemnification

You agree to indemnify, defend, and hold harmless Unheard Child Organization and its directors, officers, employees, volunteers, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your Submissions, or your violation of these Terms or any applicable law.

16. Governing Law and Dispute Resolution and Arbitration

These Terms shall be governed by the laws of the state of Colorado, without regard to conflict of law principles.

By using the Site, you agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the collection or use of information by the Organization shall first be attempted to be resolved through good-faith informal discussions. If a dispute cannot be resolved informally, it shall be resolved by binding arbitration. The arbitration shall take place in Montezuma county Colorado, unless the parties agree otherwise. You agree that any arbitration shall be conducted on an individual basis only and not as part of a class, consolidated, or representative action.

To the fullest extent permitted by law, you waive any right to a jury trial or to participate in a class action relating to any dispute arising from or related to the Site or these Terms.

Notwithstanding the foregoing, the Organization may seek injunctive or equitable relief in any court of competent jurisdiction to protect its rights, property, or confidential information.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above and, for material changes, provide additional notice through the Site or by email where appropriate. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.

18. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Site.
